These Terms and Conditions govern your use of incoloy800h.com and the supply of Incoloy 800H products by TorqBolt Private Limited (TorqBolt, we, us, our). By submitting a Request for Quotation (RFQ), placing a Purchase Order (PO) or accepting a TorqBolt Order Acknowledgement, you agree to these Terms and Conditions as the contractual framework for the supply, subject to any project-specific terms expressly negotiated in writing and signed by both parties. These Terms apply to all sales of Incoloy 800H seamless pipe, welded pipe, seamless tube, centrifugally cast tube, plate, sheet, round bar, forgings, fittings, flanges, machined components and fasteners supplied by TorqBolt against orders received through this website, by email or by any other channel.

1. Scope

These Terms apply to the supply of goods only, not services. They do not apply to consulting, engineering, design or installation services unless expressly stated in a signed agreement. The supply of any goods or services not covered here is governed by the project-specific signed agreement which takes precedence over these Terms.

2. Quotation Validity

Quotations issued by TorqBolt are valid for 30 calendar days from issue date unless a different validity is stated on the quotation. After expiry, prices, lead time and stock availability are subject to confirmation. Currency exchange fluctuations beyond +/- 3 percent during the validity period may trigger a price revision; this is flagged on each quotation. All prices are in USD unless otherwise stated. Quoted prices are EXW (Ex Works) Mumbai unless an alternative INCOTERMS 2020 delivery term is stated on the quotation.

3. Order Placement and Acceptance

A binding contract is formed when TorqBolt issues a written Order Acknowledgement against your Purchase Order. The Order Acknowledgement supersedes any conflicting terms in the PO unless those terms are expressly accepted by TorqBolt in writing. If the PO references project-specific terms (general purchasing conditions, supplier quality requirements, code requirements), those terms apply only to the extent expressly accepted on the Order Acknowledgement.

4. Payment Terms

  • Standard terms: 30 percent advance against PO, 70 percent against shipping documents (BL / AWB copy + invoice + EN 10204 certificate).
  • Established customers (3+ orders, no payment incidents): NET 30 days from invoice date, subject to credit-check approval.
  • Letter of Credit: irrevocable LC at sight, confirmed by a first-class international bank, payable against shipping documents.
  • Late payment: 1.5 percent per month interest on overdue amounts, plus reasonable collection costs.
  • Currency: USD unless otherwise stated. INR contracts for Indian customers.

5. Delivery

Delivery dates stated on the quotation or Order Acknowledgement are best-estimate dates calculated from the receipt of advance payment, approved project drawings (where applicable) and confirmed material specification. INCOTERMS 2020 applies to delivery terms (EXW / FCA / FOB / CIF / DAP / DDP as stated). Title and risk pass per the agreed INCOTERMS rule. Partial shipments are permitted unless expressly prohibited on the Order Acknowledgement.

6. Inspection Rights

The buyer has the right to witness manufacturing inspection at the TorqBolt Rajkot plant on giving 10 working days advance notice. Third-party inspection (Lloyds Register, DNV, BV, SGS, TUV) is supplied on call-out with the corresponding EN 10204 type 3.2 certificate. The buyer is responsible for inspection-related travel and accommodation costs unless the cost is included in the quotation. Goods are deemed accepted 30 days after delivery unless a written non-conformance report is issued during that period.

7. Warranty

TorqBolt warrants that the goods supplied conform to the agreed material specification (ASTM B407 / B408 / B409 / B514 / B564 / A608 or the project-specific spec), are free from defects in workmanship at the time of delivery, and meet the dimensional tolerance stated on the Order Acknowledgement. The warranty period is 12 months from delivery date or until the goods are placed in service, whichever comes first. The warranty does not cover (a) damage caused by improper installation, handling, storage or fabrication after delivery; (b) damage caused by service conditions outside the design envelope stated on the ASTM specification; (c) normal wear; (d) damage from corrosive media not disclosed at the order stage. TorqBolt's sole liability under the warranty is, at TorqBolt's option, repair, replacement or refund of the defective goods. TorqBolt is not liable for consequential, indirect, incidental or special damages including loss of production, loss of profit, downtime or interruption of business.

8. Intellectual Property

All content on incoloy800h.com - including technical text, tables, figures, design-stress data, the Incoloy 800H Data Sheet PDF, the brand mark and the TorqBolt logo - is the property of TorqBolt Private Limited and is protected by copyright. You may view and download the content for internal procurement, engineering or technical evaluation purposes; you may not republish, redistribute, sell or modify the content without written permission from TorqBolt. The Incoloy and Inconel trade names are registered trademarks of Special Metals Corporation (a Berkshire Hathaway company); reference to these marks on incoloy800h.com is for technical disambiguation and product-specification identification only and does not imply endorsement by Special Metals.

9. Export Control

Buyer represents that the goods will not be exported, re-exported, sold or transferred to any country, person or entity in violation of applicable export-control laws including but not limited to US EAR, EU Dual-Use Regulation, India SCOMET list and UN sanctions lists. TorqBolt reserves the right to decline any order that does not meet export-control screening.

10. Force Majeure

Neither party is liable for failure or delay in performance caused by events beyond reasonable control including but not limited to acts of God, war, terrorism, civil unrest, pandemic, government action, port closure, raw-material mill strike or major equipment breakdown. The affected party must notify the other party in writing within 14 days of the force majeure event. The performance obligation is suspended for the duration of the event; if the suspension exceeds 6 months, either party may terminate the affected order.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed under the laws of India. Disputes arising out of or in connection with these Terms or any order placed under them shall be referred to arbitration under the Arbitration and Conciliation Act 1996 of India, seat of arbitration Mumbai, language English, sole arbitrator agreed by both parties or, failing agreement, appointed by the Mumbai Centre for International Arbitration. The arbitration award is final and binding.
